1. Terms

By accessing this website and the Monoloci phone application (hereby known as Monoloci’s ‘platforms’), you are agreeing to be bound by these Terms of Service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing Monoloci platforms. The materials contained in these platforms are protected by applicable copyright and trademark law.

2. Use License

(a) Permission is granted to temporarily download one copy of the materials (information or software) on Monoloci’s website (and app store/google play) for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:

(i) modify or copy the materials;

(ii) use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

(iii) attempt to decompile or reverse engineer any software contained on Monoloci’s platforms;

(iv) remove any copyright or other proprietary notations from the materials; or

(v) transfer the materials to another person or “mirror” the materials on any other server.

(b) This license shall automatically terminate if you violate any of these restrictions and may be terminated by Monoloci at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format.

3. Rules of Membership

(a) Monoloci membership (use of the app, paid and unpaid) and benefits are non-transferable. Unless specifically stated, benefits apply to the Member only and may not be applied to any other individual.

(b) Rewards: Users may redeem rewards and offers at listed partner venues (known as ‘Partners’) according to the reward/offer terms and the Partner’s profile.
Please note that reward and offer restrictions may apply. Please visit the individual Partner’s profile page for additional information about a specific venue.

(c) Monoloci Partners are subject to change without notice. Active Partners are those appearing within the phone app.

(d) Users/Members must abide by any terms applicable to redeem coupons and claim prizes.

(e) You must be at least 16 years old to join Monoloci.

(f) Members may be asked to present a legal form of identification at applicable venues.

(g) Additional Partner benefits and promotions will contain specific Terms & Conditions that will be detailed within the phone app.

(h) The phone app requires being connected to the internet.

(i) Members may only have one active membership. Additional memberships attributed to the same Member will be cancelled without refund.

(j) Monoloci reserves the right to change the terms and benefits of its membership at any time.

(k) Venue staff have the right to refuse the redemption of coupons or other venue promotions, discounts or benefits to Users/Members or those affiliated in accordance with the terms and condintions or availability of reward/offer.

4. Premium Membership

Monoloci Premium subscriptions are handled through Stripe. IF your subscription is due for renewal, your payment method currently associated with your Stripe account will be charged. If your account has been closed or your payment method is otherwise invalid, your subscription may not renew and will be terminated until a valid payment method is in place.

Until you cancel, billing will continue according to the cycle stated at the time of your purchase. One-time Premium accounts will not renew.

5. Cancellation & Refund Policy

You can cancel your subscription membership through your Stripe account, the Manage Account button on the app, or if purchase via monoloci.com via My Account.

Upon cancellation of an active subscription, benefits will cease at the completion of the billing cycle. Monoloci is not under obligation to offer refunds under any circumstances.

6. Discounts

Members are entitled to utilise individual promotion/discount codes one time only. If members choose to apply a code, cancel their membership before renewal, and sign up with the same code on the same membership, they risk cancellation of that membership without refund.

7. Agreement to Rules of User Conduct

Monoloci platforms allow for users to post comments on certain stories, articles or venues. You agree to abide by Monoloci’s Rules of User Conduct, including but not limited to, agreeing not to use these platforms for any unlawful purpose.

By posting information on these platforms, you agree that you will not upload, post, or otherwise distribute or facilitate distribution of any content – including text, communications, software, images, sounds, data, or other information that:

(a) Is unlawful, threatening, abusive, harassing, defamatory, libellous, deceptive, fraudulent, invasive of another’s privacy, tortious, contains explicit or graphic descriptions or accounts of sexual acts (including but not limited to sexual language of a violent or threatening nature directed at another individual or group of individuals), uses vulgar language in the submission of any text or otherwise violates Monoloci’s rules or policies or these Rules of User Conduct;

(b) Victimises, harasses, degrades, or intimidates an individual or group of individuals on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability; infringes on any patent, trademark, trade secret, copyright, right of publicity, or other proprietary right of any party;

(c) Constitutes unauthorised or unsolicited advertising, junk or bulk e-mail (also known as “Spamming”), chain letters, any other form of unauthorised solicitation, or any form of lottery or gambling;

(d) Contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment or to damage or obtain unauthorised access to any data or other information of any third party; or

(e) Harvests or collects information about the users or members of this site or use such information for the purpose of transmitting or facilitating transmission of unsolicited bulk electronic e-mail or communications.

You further agree that you will not knowingly solicit or collect personal information from a minor (anyone under 18 years old). Personal information includes but is not limited to name, address, phone number or name of their school. Monoloci does not pre-screen, monitor, or edit the content posted by users of these platforms. However, Monoloci and its agents have the right at their sole discretion to remove any content that, in Monoloci’s judgment, does not comply with the Rules of User Conduct or is otherwise harmful, objectionable, or inaccurate. Monoloci is not responsible for any failure or delay in removing such content.

8. Disclaimer

The materials on Monoloci’s platforms are provided as is. Monoloci makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Monoloci does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its platforms or otherwise relating to such materials or on any linked sites.

9. Limitations

In no event shall Monoloci or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials on Monoloci’s platforms, even if Monoloci or an Monoloci authorised representative has been notified orally or in writing of the possibility of such damage. Because some jurisdictions do not allow limitations on implied warranties, or limitations of liability for consequential or incidental damages, these limitations may not apply to you.

10. Revisions and Errata

The materials appearing on Monoloci’s platforms could include technical, typographical, or photographic errors. Monoloci does not warrant that any of the materials on its platforms are accurate, complete, or current. Monoloci may make changes to the materials contained on its platforms at any time without notice. Monoloci does not, however, make any commitment to update the materials.

11. Links

Monoloci has not reviewed all of the sites linked to or from its platforms and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Monoloci of the site. Use of any such linked website is at the user’s own risk.

12. Site Terms of Use Modifications

Monoloci may revise these terms of use for its platforms at any time without notice. By using Monoloci platforms, you are agreeing to be bound by the then current version of these Terms of Service.

13. Right of Revocation

Monoloci reserves the right to revoke any subscription/membership, without refund, for refusal to observe the Terms of Service and/or Terms and Conditions.

14. Governing Law

Any claim relating to Monoloci’s platforms shall be governed by the laws of Australia without regard to its conflict of law provisions.

15. International Use

Monoloci makes no representation that materials on its platforms are appropriate or available for use in locations outside Australia and accessing them from territories where their contents are illegal is prohibited. Those who choose to access this site from other locations do so on their own initiative and are responsible for compliance with local laws.
